1. Who you are dealing with
FizzPoker is operated by Libaty GmbH, Am Krummen Graben 23, 63150 Heusenstamm, Germany (“we”). Contact: hello@fizzpoker.com; full details in the Impressum. “You” is anyone who opens a table, joins one or signs in.
2. What FizzPoker is — and is not
- A game, not gambling. FizzPoker is No-Limit Texas Hold’em played for play chips. Chips have no monetary value, cannot be bought, sold, transferred, won or redeemed for anything, and there are no buy-ins, prizes, payouts or cash-outs of any kind. You may not use FizzPoker to run a real-money game among yourselves; settling table results in money or goods outside the site is a breach of these terms, and where you live it may be illegal.
- Free, without a catch. There are no prices, paid plans, purchases or ads. A free account is needed only for tables of 5–9 players, more than one bot, leagues and statistics, so results can be kept for the same person.
- Private tables. A table is reachable by whoever has its link. The link is the key: share it only with the people you want at the table.
- A hobby project. FizzPoker is built and run by one developer in spare time (see About). It is offered as it is, may change, and may end (section 10).
3. Minimum age
You must be at least 16 years old to use FizzPoker. If the law where you live sets a higher minimum age for poker-themed games or for consenting to online services, that age applies to you. We may remove a table or an account if we learn that a player is too young.
4. Accounts
- An account is created by signing in with an emailed link; there is no password. Keep your inbox secure: whoever controls the email address controls the account.
- One person, one account. Do not sign up on behalf of someone else or with an address that is not yours.
- Your player name is shown to everyone at your tables and must not impersonate another person, contain contact details or anything unlawful, hateful or obscene. The same goes for a picture you upload: upload only images you have the right to use, and nothing sexual, violent, hateful or depicting other people without their consent.
- You can change your name and picture, clear your play history or delete the account at any time under Account → Settings. Deletion is described in the privacy policy.
5. Fair play and conduct
FizzPoker is for people playing cards together. At a table you agree not to:
- play more than one seat at a table, pass cards to another player, or otherwise collude — a host may seat bots, but a human player may not be replaced or assisted by software during a hand;
- use automation, scripts, extensions or other programs to act for you or to read anything the table does not show you;
- exploit a bug instead of reporting it to us;
- harass, threaten or insult other players in chat or through your name, send spam or unsolicited links, or post anything unlawful;
- interfere with the service, probe it for weaknesses without our written permission, or load it with automated traffic.
Hosts run their tables: a host may mute a player’s chat and decides who gets the link. Chat and reactions are relayed live and not stored by us; what other players do with what they see at the table is up to them.
6. Your name, picture and chat
You keep every right to the name, picture and messages you bring to a table. You grant us the non-exclusive, free licence to show them to the players of your tables, on the recap page of a finished game and in your league, for as long as you keep them on the site — nothing more. We may remove or replace a name or picture that breaks section 4 or 5, and may suspend or delete an account that repeatedly does.
7. The Fizz Score is an estimate
The post-game review compares your decisions with game-theory models and labels them. It is an advisory second opinion computed from a simplified model of the game: it can be wrong in unusual spots, it covers only the situations it has models for, and it appears only after the hand. It is not coaching, not a guarantee of anything and not a judgement of you. The Fizz Score page explains the method and its limits.
8. Bots
Bots are computer players you can seat at your own table. They play the game as it is shown to them and never see hidden cards. A bot level is a rough indication of strength, not a promise of how a game will go.
9. Our content
The game, its code, drawings, sounds, texts, guides and tools belong to Libaty GmbH or its licensors. You may use them to play and learn, link to any page, quote short passages with attribution, and screenshot or stream your games. You may not copy, sell, scrape for resale or re-host the site or its content, or remove any notice on it.
10. Availability and changes
FizzPoker is provided free of charge and as it is. We try to keep it up, but we do not promise that it is available at any time, that games never break, or that stored games, statistics or leagues are never lost. We may change, pause or discontinue any part of the service, including the whole of it, at any time; if we end the service or delete accounts for a reason other than a breach of these terms, we will announce it on the site in advance where reasonably possible.
11. Liability
Because FizzPoker is free, our liability is limited as far as German law allows for services provided free of charge: we are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, under the Product Liability Act and under any guarantee we have expressly given. For slight negligence we are liable only for the breach of an obligation that is essential to the service (a cardinal obligation), and then only for the foreseeable damage typical of a game of this kind. Any further liability is excluded. You are responsible for your own equipment and connection.
12. Ending the agreement
You can stop using FizzPoker at any time, and delete your account under Account → Settings. We can close a table, remove content, or suspend or delete an account that breaches these terms; for a serious breach (real-money play, collusion, automation, harassment, unlawful content) without notice. A deleted account’s games stay in the records without the player’s name, as the privacy policy describes.
13. Changes to these terms
We may change these terms when the service, the law or our business changes. The new version is published on this page with its date; for signed-in players we announce substantial changes on the site at least four weeks before they take effect. If you keep using FizzPoker after that date, the new terms apply; if you do not agree, stop using the service or delete your account.
14. Law, courts and language
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer in another country of the European Union, you keep the protection of the mandatory rules of your own country. For merchants, legal entities and persons without a general place of jurisdiction in Germany, the courts of Offenbach am Main have exclusive jurisdiction. These terms are written in English; where German law requires a German reading, the English text is to be understood in its ordinary meaning.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§36 VSBG).
15. If a clause is invalid
Should one of these clauses be or become invalid, the rest remain in force; the statutory rules take the invalid clause’s place.
